Being active on the Luxembourg financial market since the early 90’s, MOLITOR has developed a strong client portfolio of local and international clients: banks and financial institutions. The banking and finance team regularly advises domestic and foreign banks, insurance companies and other professionals of the financial sector on legal matters arising from their business activities. Our lawyers draft contractual documents ranging from general terms and conditions to portfolio management agreements, finance and security documents. We prepare credit agreements and help to structure financial transactions for corporate clients. Our expertise also includes banking corporate law, white collar crime, contract law, banking secrecy, offering and listing of securities.
In the area of insurance law, the firm’s expertise involves drafting and reviewing insurance contracts, policy wording and interpretation, ensuring compliance with the legal regulations of supervisory bodies, representing clients in a range of insurance litigation matters as well as handling civil and professional liability issues.
In 2007 MOLITOR provided advice and assistance to European banks established in Luxembourg with respect to the Markets in Financial Instruments Directive (MiFID) implementation, which involved drafting and updating legal documentation including general terms and conditions, client agreements, distribution agreements, inducement procedures, best execution policy and client classification policies.
